Filing Deadlines:

Inheritance tax returns must be filed within a period of six months from the death of the deceased. The inheritance prescription takes place after four years and six months from the death of the deceased.

The tax return requires the inheritance deed along with the corresponding form; the execution of the inheritance deed may be postponed, but not the tax return, for which it will be necessary to attach the corresponding form to a petition that inventories the assets, along with the will and death certificate.

Tax Treatment:

Inheritance is subject to Inheritance and Gift Tax, which is a tax transferred to the autonomous communities, and the treatment varies greatly depending on the Autonomous Community in question.

Required Documentation:

  • Death certificates and certificates from the General Registry of Last Wills, together with the certified copy of the will.

  • If there is a declaration of intestate heirs, the certified copy of the act, or a copy of the judicial act declaring the heirs.

  • Data of the heirs and spouse (if any). ID card.

  • Property titles of the inherited assets.

  • Property tax receipts for the last year.

  • Bank statements of securities, accounts, investment funds that are part of the inheritance, and statements of the previous year's transactions.

  • Debts that may exist and expenses made directly related to the death.
